PATENTS: AVOIDING ANTITRUST LITIGATION AND USE OF SURVEYS Wednesday, October 12, 2012 1 PM EST / Noon CST / 11 AM MST / 10 AM PST (90 Minutes) The ever-shifting law on damages in patent and Intellectual Property litigation is the subject of the October webinar. Damages experts Krista Holt and Gauri Prakash-Canjels of GreatBridge Consulting will analyze recent Federal Circuit cases, particularly the recent Uniloc v. Microsoft case, overturning the so-called "25% rule of thumb" analysis as "fundamentally flawed" and the recent case, Inventio AG v. Otis Elevator Co. that clarified the entire market value rule. The speakers will also address ongoing issues involving the Lucent v. Gateway decision, where the Federal Circuit suggested that a survey could have been used to determine demand for a patented technology. The speakers will also address the possible antitrust implications of patent licenses.
