LES Boston Chapter Meeting DATE & TIME Tuesday, March 12, 2013 4:30 PM – 7:00 PM TITLE Financing or Insuring Intellectual Property Enforcement/Defense DESCRIPTION Surveys over the last decade have established median costs of patent litigation as $1.5 million through discovery and $2.5 million through trial and appeal for cases in which $1-25 million were at risk. How can a small- or middle-market company afford to enforce its patent rights? If it can’t, why would others respect their patents? And how would they defend against assertion by others? In the high-margin industries served by members of LES, the problem is endemic. We expect at this meeting to exchange ideas on this theme and otherwise network around brief presentations of solutions: Stephen Y. Chow, Esq., of Burns & Levinson LLP, a high-tech patent practitioner, litigator and transactional lawyer, will present a current matrix of options (including administrative and investor-backed) and supply written materials with additional detail. Garen P. Suzan of Trilogy Insurance Group, Inc., will reprise portions of a very-well attended LES webinar on “Intellectual Property Risk Management,” outlining available insurance options for both enforcing and defending against enforcement of intellectual property. There will be an explanation of the tasks, costs and general strategies of litigation that will help in business planning.
